1. Acceptance of these terms
By downloading or using ClearWave, you agree to these Terms of Use. If you do not agree, do not use the app. Your use of ClearWave may also be subject to Apple’s App Store terms and the Apple Standard Licensed Application End User License Agreement.
2. License and permitted use
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use ClearWave on Apple devices that you own or control, subject to these terms and Apple’s usage rules.
You may not copy, modify, reverse engineer, redistribute, sell, rent, sublicense, interfere with, or attempt to extract the source code of ClearWave except where applicable law expressly permits it.
3. Speaker cleaning and measurement disclaimer
ClearWave generates audio and haptic patterns intended to help move water or loose debris from a device speaker. Results vary by device, speaker condition, obstruction, and exposure. ClearWave does not guarantee that a cleaning cycle will remove all water or debris or repair damaged hardware.
Decibel readings are estimates for everyday reference. iPhone microphones are not certified professional sound-level meters, and ClearWave must not be used for occupational safety, medical, legal, engineering, or other calibrated measurement purposes.
If your device is hot, visibly damaged, exposed to hazardous liquid, or behaving abnormally, stop using it and follow the manufacturer’s safety instructions or seek qualified service.
4. Your responsibilities
- Use ClearWave lawfully and follow device-manufacturer safety guidance.
- Do not play high-volume tones near your ears or another person’s ears.
- Do not rely on ClearWave as a substitute for professional device repair or calibrated acoustic equipment.
- Keep your Apple ID and device access secure.
5. Subscriptions and purchases
Paid features may be offered through auto-renewing subscriptions or other in-app purchases. Pricing, billing period, trial availability, and included features are shown in the app before purchase. Payment is charged by Apple to your Apple ID.
Subscriptions renew automatically unless canceled through your Apple ID settings at least 24 hours before the end of the current period, subject to Apple’s rules. Refunds and billing disputes are handled by Apple. Restoring purchases requires the Apple ID used for the original purchase.
6. Intellectual property
ClearWave, its visual design, software, audio sequences, branding, text, and other content are owned by us or our licensors and are protected by intellectual-property laws. These terms do not transfer ownership rights to you.
7. Third-party services
ClearWave relies on Apple services such as StoreKit, notifications, audio frameworks, and the App Store. Those services are operated under Apple’s own terms and policies, and their availability may affect ClearWave features.
8. Availability and changes
We may update, improve, suspend, or discontinue features to maintain security, comply with law, or improve the product. We do not guarantee that every feature will always be available on every device or iOS version.
9. Disclaimer of warranties
To the maximum extent permitted by law, ClearWave is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Rights that cannot legally be excluded remain unaffected.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, data loss, loss of use, or device damage arising from your use of or inability to use ClearWave. Nothing in these terms excludes liability that cannot be excluded under applicable law.
11. Termination
You may stop using ClearWave at any time. We may suspend or terminate access if you materially violate these terms or if necessary for security or legal compliance. Provisions that by their nature should survive termination will continue to apply.
12. Changes and contact
We may update these terms from time to time. Continued use after an update becomes effective constitutes acceptance where permitted by law. Questions can be sent to dailituweb@gmail.com.
